A. COLLECTION AND USE OF INFORMATION
In the conduct of our business, we collect and keep personally identifiable information (e.g. name, street address, email address, and telephone number) about our clients including and other similar data that may relate to the personal, professional, career, or business attributes of our client.
For the protection of the privacy and interest of our clients, we consider every writing engagement that we transact and enter into as a strictly private and confidential matter between us and our client, a relationship that we must uphold to the exclusion of any third party except under any of the following circumstances:
- where our client, because of satisfactory results of the works that we have done, voluntarily consent to let others know our prior transactions (e.g. client testimonials)
- where access to our internal information may be required by law (e.g. government tax audits) or by virtue of a court order that could emanate from a court litigation (e.g. collection case) or in response to law enforcement authorities when in our judgment we are reasonably required to allow access to company-held client information
- where customer information may be part of the transfer of assets in case we decide to sell our interest or buy, merge, or partner with other businesses for growth or competitive considerations, and
- where the provision of technical support by third parties (e.g. external website administrator doing system maintenance, troubleshooting, or developing e-commerce applications) may necessitate access to our customer database.
Under exceptions 2-4, we may not provide our client prior notice on the disclosure of such information.
The personally identifiable information that we collect are those in written forms that may have been prepared by our clients or by us for the completion of our client, and collected by us either through our website or through email, mail, telephone, or personal meetings during the course of normal business. We may internally use personally identifiable information under any of the following circumstances:
- addressing our client’s inquiries and service requests
- developing and rendering personalized client services
- maintaining information as a baseline source or reference
- undertaking market research and client knowledge programs
- communicating with our client during and after the engagement (except where there is a written request from our client for no further contact after the project engagement, in which case, we will honor the request)
We exercise extraordinary vigilance in protecting all personally identifiable information about our clients. We will never sell, barter, lease, share, lend, give away, or distribute this information in any manner without first getting the explicit written permission of our client.
On collected aggregated information (i.e. information that does not personally identify our client), we may use this information in a number of ways such as: combining data on our clients’ general profiles and usage patterns to enhance our site, service, and customer relationship capability or occasionally sharing the information with our site advertisers, customers, and business partners.
B. OTHER WEBSITE LINKS
Our site may contain, now and in the future, links to others websites that are beyond our control and are outside of the coverage of this Privacy Policy. Third parties, which include partners, affiliates, advertisers, and other content providers that may be accessible to our site now and in the future, may have their own different confidentiality and privacy policy as well as data collection policies and practices. For instance, visitors and clients using our site may be linked, introduced, or be able to access information, Web sites, contests, lottery, and other online features that are actually created or hosted by third parties. We will not be responsible for any contrary privacy policies or data collection practices of these third parties.
We will not also be responsible should any of our partners, site administrators, affiliates, agents, licensors, suppliers, advertisers, and distributors, or third parties, in our site use cookies or other technologies to retrieve information about our clients. We must also stress that if any of our clients voluntarily disclose personally identifiable information, either in chat areas or on message boards, the information can be viewed publicly and can be collected and used by third parties without our knowledge. We remain not responsible for such activities that may result to multiplicity of unsolicited messages from other individuals or entities.
C. DISCLAIMER OF LIABILITY
Due to a variety of links and sources from which information on our site is and may be obtained, now and in the future, and the inherent risks attached to electronic communication, we and our partners, site administrators, affiliates, agents, licensors, suppliers, advertisers, and distributors cannot and do not warrant the accuracy, completeness, applicability, timeliness, merchantability, non-infringement, or utility of the information available through our service or the site itself.
We and our partners, site administrators, affiliates, agents, licensors, suppliers, advertisers, and distributors will not be responsible to our client or to anyone for any delays, omissions, dysfunctions, and inaccuracies in the information available through our service, or our site itself; or for any indirect, special, incidental, consequential, or exemplary damages arising from our client’s use of our site, software, or any information obtained from the site. These exclusions apply to any claims for lost business, lost profits, lost information, loss of relationship or goodwill, work stoppage, system outage, hardware failure or malfunction, or any other commercial damages or losses, even if we knew or should have known the possibility of such damages. In jurisdictions where the exclusion or the limitation of liability for consequential or incidental damages is not allowed, our liability and that of our supplier in such jurisdictions shall be limited to the extent permitted by law.
We and our partners, site administrators, affiliates, agents, licensors, suppliers, advertisers, and distributors will not be liable to our client or to anyone else for any loss or injury caused in whole or in part by negligence, omission, or uncontrollable contingency in procuring, compiling, interpreting, reporting, or delivering the service or any news or information through our site. This non-liability clause applies to any decision made by anyone as a result of or in reliance on such news and information, and to any consequential, special, or similar damages, even if we knew or should have known the possibility of such damages.
